These Terms apply to all users of QuoteIQ, including account holders (business owners), employees who access QuoteIQ through an employer’s account, and any person who interacts with the Services.
01A Supplemental Terms
Certain Services are governed by additional terms that supplement these Terms (“Supplemental Terms”). The following Supplemental Terms are incorporated into these Terms by reference:

- Whop Terms of Service — governs payment processing provided through Whop
- QuoteIQ Affiliate Program Terms — governs participation in the QuoteIQ Affiliate Program
- QuoteIQ SMS Terms and Conditions — governs text messages sent through the QuoteIQ platform
If there is a conflict between these Terms and any Supplemental Terms, the Supplemental Terms control for the specific Service or program they govern; these Terms control on all other matters. Section 25 of these Terms (Governing Law & Dispute Resolution) governs all disputes arising under any Supplemental Terms.

Price Lock Guarantee. Your subscription rate will remain unchanged for as long as you maintain an uninterrupted subscription on the same plan, even if our published pricing increases. If you cancel your subscription and later return, the pricing in effect at the time you resubscribe will apply. If you switch plans, the current pricing for your selected plan will apply.
Certain features are only available on specific plans. Access to features is determined by your active subscription tier. You may upgrade or downgrade your plan at any time.
We reserve the right to change our published pricing at any time, subject to the Price Lock Guarantee above. Any price changes applicable to your subscription will take effect at the start of your next billing cycle. We will provide advance notice of material price changes by email or in-app notification.
Pricing Terms Take Precedence. If there is any conflict between the pricing, billing, or subscription provisions in these Terms and Conditions and information published on our website, pricing pages, marketing materials, or other communications, these Terms and Conditions will govern.
05A Platform Changes & External Content Disclaimer
Right to Modify the Platform
QuoteIQ reserves the right to add, modify, remove, rename, or discontinue any feature, tool, subscription tier, plan name, or plan benefit at any time, with or without prior notice, at our sole discretion. This includes but is not limited to: AI features, IQ Credit allocations, user limits, integrations, and any functionality described within the Services.
Pricing Changes
We reserve the right to change subscription pricing, add new tiers, discontinue existing tiers, or restructure our pricing model at any time. Changes to your active subscription price will take effect at the start of your next billing cycle, and we will provide notice via email or in-app notification. Promotional or introductory pricing is not guaranteed to continue.
Website Content is Informational Only
The content published on myquoteiq.com — including feature descriptions, pricing tables, screenshots, comparison charts, and promotional copy — is provided for general informational purposes only and is subject to change at any time without notice. Nothing on the QuoteIQ website constitutes a binding offer, contract, or guarantee of specific features, pricing, or availability.
Previously Published & Third-Party Content
QuoteIQ publishes content across various channels including, but not limited to, YouTube, social media platforms, email campaigns, blog posts, podcast appearances, advertisements, affiliate materials, and other owned or third-party platforms. Once published, this content remains accessible indefinitely and may reflect features, pricing, subscription tiers, promotional offers, or special deals that were accurate at the time of publication but are no longer current, available, or valid. The existence of any published content — on QuoteIQ’s own platforms or elsewhere — does not constitute a binding offer or guarantee. Pricing, features, and offers are subject to change at any time. Users should not rely on any video, post, advertisement, or promotional material as a representation of current pricing or platform capabilities, regardless of the source or platform on which it appears. The only authoritative, up-to-date source for current pricing is myquoteiq.com/pricing and for current Terms is myquoteiq.com/terms-conditions.
06 IQ Credits
IQ Credits (“IQC”) are virtual credits used to access AI Features within QuoteIQ. Every subscription plan includes a monthly allocation of IQ Credits.
How IQ Credits Work
- IQ Credits are included with your subscription at no additional cost
- Credits reset at the beginning of each billing cycle — unused credits do not roll over
- Different AI Features consume different amounts of credits per interaction
- Your credit balance is visible within the AI interface
- When you exhaust your monthly allocation, AI Features will be unavailable until your credits reset at the next billing cycle, unless you purchase additional credits
IQ Credit Usage
- AI Autopilot: Credits consumed per conversation/command
- Virtual Call Team: 125 IQC per minute of call time
- AI Estimator: Credits consumed per estimate generated
- Before/After Image Generation: Credits consumed per image generated (including regenerations)
- AI Text Generator: Credits consumed per text generation
No Monetary Value: IQ Credits have no cash value and cannot be exchanged, transferred, sold, or refunded. IQ Credits are a usage allocation, not a currency or stored value.
Optional AI Services & Credits
Certain optional AI-powered services, including but not limited to Virtual Call Team and AI Autopilot, may consume usage-based AI credits.
AI credits are optional and are not required to use the core QuoteIQ CRM platform.
AI credit purchases are non-refundable once purchased or consumed unless otherwise required by applicable law. Unused credits have no cash value, are non-transferable, and may expire in accordance with the terms set forth at the time of purchase.
07 Free Trial
QuoteIQ offers a 14-day free trial on eligible subscriptions, subject to the exclusions below. The trial provides access to the features of the plan selected at signup. A valid credit or debit card is required to start the trial.
Trial Terms
- The trial period is 14 days from the date of registration
- You will have full access to the features of the plan you selected during the trial
- If you do not cancel before the trial expires, your subscription will automatically convert to a paid plan at the rate corresponding to the plan you selected during registration
- You may cancel at any time during the trial period without being charged
- Only one free trial per person, per business, or per payment method
Mobile App Users: If you subscribe through the Apple App Store or Google Play Store, your trial and subscription are governed by the applicable app store’s terms. Manage your subscription (including cancellation) through your app store account settings.
Special Offers & Discounted Annual Subscriptions
The 14-day free trial is not available for annual subscriptions purchased through special offers or promotional offers, unless the specific offer expressly states otherwise in writing.
For these purchases, the paid subscription term begins upon purchase, and the applicable subscription fee is charged immediately. For annual subscriptions, the full annual subscription price disclosed at checkout is charged at that time.
The absence of a free trial and the payment amount will be clearly disclosed before purchase.
The trial-period cancellation provisions in this Section do not apply to these purchases. Cancellation and refund requests are governed by Section 9 and any applicable written offer terms. Nothing in this provision limits rights or remedies that cannot be excluded under applicable law.
08 Payment & Billing
Accepted Payment Methods
QuoteIQ accepts the following payment methods for subscriptions:
- Credit and debit cards (Visa, Mastercard, American Express, Discover) — processed by Whop (new subscribers) or Stripe (legacy subscribers)
- In-app purchases through Apple App Store or Google Play Store (for mobile subscriptions)
Payment for Your Customers’ Invoices
When your End Customers pay invoices through QuoteIQ, the following payment methods are available:
- Credit/debit cards, ACH bank transfer, Apple Pay, Google Pay (online)
- Cash and check (recorded manually in app)
Customer Fees, Surcharges & Legal Compliance
If you use QuoteIQ to add or collect a convenience fee, credit card surcharge, administrative fee, service fee, or other additional customer charge, you are responsible for determining whether that charge is permitted for your business, jurisdiction, payment method, and transaction.
Before enabling or imposing any such charge, you must verify compliance with all applicable federal, state, and local laws, payment processor requirements, and card-network rules. You should consult qualified legal counsel or the appropriate regulatory authority where clarification is needed.
Your responsibilities include complying with any restrictions on eligible payment methods, credit versus debit or prepaid cards, fee amounts, calculation methods, notices, customer disclosures, consent, receipts, and available payment alternatives. You must not impose a charge where prohibited.
The availability of a fee-setting feature within QuoteIQ does not constitute legal advice, authorization to impose a fee, or a representation that the fee is lawful in every jurisdiction. A fee’s label does not determine its legal treatment. Customer consent or the availability of another payment method does not, by itself, establish that a fee is permissible.
You must ensure that any permitted fee and the total payment amount are clearly disclosed before the customer authorizes payment. You are responsible for reviewing your configuration and discontinuing or correcting charges that do not comply with applicable requirements.
QuoteIQ reserves the right to restrict, disable, or modify fee functionality to address legal, regulatory, payment processor, or card-network requirements.
Nothing in this section waives any nonwaivable customer rights or excludes any responsibility that applicable law places on QuoteIQ.
Recurring Billing
Your subscription renews automatically at the end of each billing period (monthly or annually) at the then-current price for your plan. By subscribing, you authorize us to charge your payment method on a recurring basis without requiring separate approval for each charge.
All payments are in U.S. dollars. Sales tax will be applied where required by law.
Promotional Pricing & Coupon Codes
Coupon codes and promotional discounts apply only to the subscription term in which they are redeemed. For annual subscriptions, a coupon discount applies to the first 12 months only. Unless the specific offer expressly states otherwise in writing, the subscription renews at the then-current standard price for your plan at the end of the discounted term. Coupon codes are not transferable, may not be combined unless expressly stated, and may be modified or discontinued at any time.
Payment Processing
Subscription payments are processed by our third-party payment processors. QuoteIQ does not store your credit card numbers or bank account details.
- New subscribers. Whop (Whop Inc.) is the only payment processor available for new subscriptions. Payment data is subject to Whop’s Terms of Service and Whop’s Privacy Policy. Subscription charges processed through Whop may appear on your card or bank statement under a descriptor that includes Whop’s name, and refunds and disputes on those charges are processed through Whop.
- Legacy subscribers (Stripe). Stripe is a legacy payment processor. Subscribers whose accounts were established on Stripe may either continue using Stripe or migrate to Whop. Migration is one-directional: once you move from Stripe to Whop, you cannot move back to Stripe. Stripe is not available to new subscribers. Payment data processed through Stripe is subject to Stripe’s Privacy Policy and Stripe’s Services Agreement.
Processing Fees
Transactions processed through QuoteIQ are subject to payment processing fees, platform fees, and other applicable charges. Fees may vary based on payment method, account configuration, processor requirements, risk profile, industry type, dispute history, transaction volume, or other operational factors.
Current pricing may be displayed within the platform, billing section, onboarding materials, or pricing pages and may be updated from time to time, with or without prior notice. Updated fees will be reflected on the applicable pricing page or within the platform at the time of change.
Applicable fees may be deducted directly from transaction payouts prior to deposit.
QuoteIQ reserves the right to establish, modify, or impose reserve requirements on any account based on risk profile, dispute history, transaction volume, industry type, or processor requirements. Reserves may be held for any duration deemed necessary by QuoteIQ or its payment processors.
Third-Party Payment Processing
Payment processing services are provided by third-party payment processors, including Whop, Inc. and Stripe, Inc., and are subject to the applicable processor’s terms, policies, underwriting requirements, reserve requirements, and financial institution rules.
QuoteIQ is not a bank, merchant processor, money transmitter, or financial institution.
QuoteIQ shall not be liable for:
- processor outages
- payout delays
- frozen or held funds
- reserve requirements
- underwriting decisions
- processor terminations
- banking interruptions
- failed transactions
- declined payments
- payment reversals
- chargebacks
- or any other action, inaction, or decision made by a third-party payment processor, financial institution, or banking partner, whether or not specifically enumerated herein
QuoteIQ reserves the right to suspend, delay, restrict, or terminate payment functionality at any time if fraud, excessive disputes, elevated risk, suspicious activity, compliance concerns, or unpaid balances are identified.
Payment processing availability may vary by region and jurisdiction. QuoteIQ makes no representation or guarantee that payment services are available in all locations or that all payment methods are supported in every jurisdiction.
Chargebacks & Payment Disputes
Users are solely responsible for all chargebacks, disputes, reversals, refunds, returned payments, fines, penalties, and associated fees arising from transactions processed through QuoteIQ.
QuoteIQ reserves the right to:
- recover disputed amounts
- offset balances
- debit payment methods on file
- withhold payouts
- establish or increase reserves
- or suspend payment functionality without liability to QuoteIQ
These remedies apply regardless of whether the disputed transaction occurred prior to, during, or after cancellation of a QuoteIQ subscription or account.
Processing fees, platform fees, and dispute-related fees are non-refundable, including in situations involving customer disputes, payment reversals, or account termination.
Authorization to Charge Payment Methods
By using QuoteIQ, you authorize QuoteIQ and its payment processors to charge any payment method on file for:
- subscription fees
- processing fees
- AI credit purchases
- disputes or chargebacks
- negative balances, including balances arising from chargebacks, disputes, or refunds issued after subscription cancellation
- penalties
- or any other amounts owed in connection with your use of the Services
This authorization remains in effect until all outstanding balances are resolved, regardless of account status or cancellation.
09 Cancellation & Refunds
How to Cancel
- Web/Direct Subscriptions: Cancel in the settings within the app, or log in to myquoteiq.com and cancel there.
- App Store Subscriptions: Cancel through your Apple App Store or Google Play Store subscription settings. QuoteIQ cannot process cancellations for app store subscriptions directly.
Cancellation
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. To avoid being charged for the next period, you must cancel before your renewal date. Cancellation stops future renewals only. It does not end your current billing period and does not entitle you to a refund for the current period. After cancellation, you retain access to the Services until the end of your current paid billing period.
Refunds
All fees are earned when paid and are non-refundable. This includes, without limitation, no refunds or credits for partial billing periods, unused time, downgrades, features you did not use, or dissatisfaction with the Services.
Annual and Lifetime Plans
Annual and lifetime plans are prepaid for their full term and are non-refundable. Except as provided under Exceptional Circumstances & Early Annual Subscription Refunds below, annual and lifetime plans are not eligible for mid-term cancellation, proration, or partial refund. Annual plans provide access through the end of the paid term. Lifetime plans provide access for as long as the Services remain available.
Chargebacks
Initiating a chargeback or payment dispute without first contacting us to resolve the issue, and in violation of these terms, may result in immediate suspension or termination of your account. We reserve the right to recover the disputed amount along with any associated fees and costs.
Exceptional Circumstances & Early Annual Subscription Refunds
Cancellation of Renewal. Canceling automatic renewal does not incur a fee. Unless an early termination and refund is approved, your subscription remains active through the end of the paid term.
Discretionary Early Refunds. Annual subscriptions remain non-refundable except where required by applicable law or expressly provided in an applicable written offer. QuoteIQ may, at its discretion, approve a request to terminate an annual subscription before the end of its paid term and refund a portion of the unused subscription value. Approval in one instance does not create an entitlement to a refund in another.
Proration. Unused subscription value is calculated using the annual subscription price actually paid, after discounts and excluding separately stated taxes, multiplied by the proportion of the paid term remaining at the agreed effective termination time. The calculation uses the actual duration of the subscription term.
Early Termination Fee—15% Cap. Where permitted by applicable law, an approved discretionary early refund is subject to an early termination fee equal to 15% of the unused subscription value. This fee includes all payment-processing, transaction, commission, and administrative costs deducted in connection with the early termination and refund. No separate deduction for those costs will be added. Total deductions from the unused subscription value will never exceed 15% of that value. QuoteIQ may reduce or waive the fee.
The refund equals the unused subscription value minus the applicable fee, plus any tax adjustment required by law. No additional charge will be made to the customer’s payment method as part of this calculation.
Refund Confirmation & Access. Before processing the refund, QuoteIQ will provide an itemized calculation and obtain the customer’s written acceptance of the refund amount and effective termination date. Access to paid features ends on that date. Data retention and deletion remain governed by Section 16.
Exceptions. This fee does not apply to refunds required by law, corrections of duplicate or erroneous charges, or refunds of unauthorized payments. Nothing in this provision limits rights that cannot lawfully be waived. Purchases through an app store remain subject to that store’s applicable terms and refund procedures.
Data
Your User Data remains accessible through the end of your current paid billing period. After that period ends, your User Data is retained for 30 days and is then permanently deleted. Export anything you need to keep before that 30-day period ends (see Section 16).
Downgrade Effects
If you downgrade to a lower plan, features available only on higher plans will become inaccessible. Data associated with those features (for example, pipeline deals or inventory records) will be retained but not accessible while you remain on the lower plan, and will become accessible again if you upgrade to a plan that includes those features. If a downgrade causes your usage to exceed the limits of your new plan, some data or functionality may become restricted until you reduce usage to within those limits or upgrade. We are not responsible for any loss of access resulting from a plan change you initiate.
09A Refund Policy for Digital Products & Services
Digital Deliverables Are Non-Refundable
All purchases of digital products, digital downloads, customer contract templates, service agreement templates, marketing materials, advertising copy, promotional templates, AI Credits, and any other digital content provided by QuoteIQ LLC (collectively, “Digital Deliverables”) are final and non-refundable upon delivery.
Digital Deliverables are deemed delivered when they are transmitted electronically, emailed to the User, made available for download, made accessible through the QuoteIQ platform, or otherwise provided electronically. Upon delivery, QuoteIQ has fully performed its obligations with respect to the purchase.
Because Digital Deliverables are provided in electronic form and cannot be returned, revoked, or rendered unusable after delivery, no refunds, credits, exchanges, or cancellations will be issued once delivery has occurred. Whether or not the User downloads, opens, reviews, copies, uses, or implements the Digital Deliverable has no effect on the finality of the sale.
By purchasing any Digital Deliverable, the User acknowledges and agrees that: (i) delivery constitutes full performance by QuoteIQ; (ii) all sales are final upon delivery; and (iii) the purchase was made voluntarily with full knowledge of this Refund Policy.
Done-For-You (DFY) Services
Done-For-You (“DFY”) services, including but not limited to account setup, software configuration, onboarding, template creation, custom integrations, account build-outs, and any other professional services performed by QuoteIQ personnel, are also final and non-refundable once performance has commenced.
Performance shall be deemed to have commenced upon the earlier of:
- assignment of QuoteIQ personnel
- creation of project files
- communication regarding implementation
- commencement of setup or configuration
- or any labor performed in connection with the requested service
Because DFY Services involve professional labor, expertise, and time that cannot be recovered once performed, no refund shall be issued for completed or partially completed services, including where the User later changes their mind, fails to respond, cancels the project, or elects not to complete implementation.
IQ Credits (AI Credits)
IQ Credits (AI Credits) purchased through the QuoteIQ platform are non-refundable upon purchase, regardless of whether they have been used. IQ Credits have no cash value, are non-transferable, may not be redeemed for cash or credit, and expire without value upon cancellation or termination of the applicable account.
Affirmative Acknowledgment at Purchase
At the time of purchase, Users are required to affirmatively acknowledge the non-refundable nature of Digital Deliverables, DFY Services, and IQ Credits before completing the transaction. Such acknowledgment constitutes the User’s informed electronic consent to this Refund Policy and forms part of the binding purchase agreement between the User and QuoteIQ.
Chargebacks Related to Digital Purchases
Users agree to contact QuoteIQ before initiating any chargeback or payment dispute. Where QuoteIQ has fulfilled its contractual obligations through delivery of Digital Deliverables or commencement of DFY Services, the User agrees that a chargeback is not an appropriate remedy. QuoteIQ reserves the right to contest any payment dispute using purchase records, delivery confirmations, system logs, account activity, electronic acknowledgments of these Terms, communications with the User, and any other evidence demonstrating fulfillment of its obligations. Accounts subject to fraudulent, abusive, or unwarranted chargebacks may be suspended or terminated until the matter has been fully resolved.
Discretionary Refund for Technical Failures
In the event of a documented technical failure directly caused by QuoteIQ that results in verified non-delivery of a Digital Deliverable or verified non-performance of a purchased DFY Service, QuoteIQ may, in its sole and absolute discretion, issue a refund, partial refund, account credit, or another appropriate remedy. This provision does not create any obligation for QuoteIQ to provide a refund and shall not be construed as a waiver of this Refund Policy. Any such request must be submitted in writing to QuoteIQ Support within thirty (30) days of the alleged issue and include sufficient documentation to allow QuoteIQ to investigate the claim.
10 AI Features & Automated Tools
Important: AI Features generate output based on automated analysis. AI output may contain errors, inaccuracies, or inappropriate suggestions. You are solely responsible for reviewing, verifying, and approving all AI-generated content before using it in your business or sharing it with End Customers.
AI Features Overview
QuoteIQ includes the following AI-powered features, all of which consume IQ Credits:
- AI Autopilot: A conversational AI assistant that executes CRM actions (create estimates, send invoices, schedule jobs, text customers, etc.) through natural language text or voice commands
- AI Estimator: Analyzes photos and job descriptions to generate pricing estimates. Estimates are recommendations based on automated analysis of property characteristics and local market data
- Before/After AI Image Generation: Creates AI-generated preview images showing expected results after service completion, based on photos you upload
- AI Text Generator: Generates suggested text for customer messages and communications
- Virtual Call Team: AI-powered phone agents that handle calls (see Section 11)
AI Service Provider
AI Features are powered by third-party AI providers, currently including Google Gemini, OpenAI, and ElevenLabs, and the AI Website Builder is provided through 10Web. When you use an AI Feature, your input data (text, photos, voice, call audio) is transmitted to the applicable provider for processing. The provider processes this data and returns the AI output to QuoteIQ. QuoteIQ may add, remove, or change AI providers at any time. For details on how AI data is handled, see our Privacy Policy, Section 6.
Your Responsibilities
- Review all AI output. AI-generated estimates, images, text, and actions are recommendations only. You must review and approve all AI-generated content before sending it to End Customers or relying on it for business decisions
- Pricing accuracy is your responsibility. AI Estimator pricing is based on automated analysis and may not reflect actual costs, local market conditions, or your specific pricing structure. You are solely responsible for the accuracy of all pricing sent to your customers
- AI-generated images are approximations. Before/After images are AI-generated predictions, not guarantees of actual results. Do not represent AI-generated images as photographs of actual completed work
- AI actions are executed as requested. AI Autopilot executes commands based on your instructions. If you instruct Autopilot to send an invoice or text a customer, that action is performed. Verify your commands before confirming
Acceptable Use of AI Features
You agree not to use AI Features to:
- Generate fraudulent or deceptive estimates, invoices, or communications
- Impersonate another person or entity
- Generate content that is illegal, harmful, harassing, or discriminatory
- Attempt to extract, reverse-engineer, or reproduce the underlying AI models
- Circumvent IQ Credit limits through automated scripting or abuse
- Use AI-generated output in a way that violates any applicable law or regulation
No Guarantee of Availability or Accuracy
AI Features depend on third-party AI services (including Google Gemini, OpenAI, and ElevenLabs) and may be temporarily unavailable, degraded, or produce inconsistent results. We do not guarantee the accuracy, reliability, completeness, or availability of any AI Feature. AI Features are provided “as is.”
11 Virtual Call Team
The Virtual Call Team is an AI-powered phone system that handles inbound and outbound calls on your behalf.
Call Recording & Transcription
Call recording and call transcription are optional and are turned off by default. Each feature is controlled separately and must be enabled by you in Virtual Call Team settings.
- When recording or transcription is enabled, QuoteIQ automatically tells callers at the start of each call that the call is recorded and handled by an AI assistant. When both are off, callers are told that the call is handled by an AI assistant.
- Call summaries are created only when transcription is enabled
- Call recordings, transcripts, and summaries are stored for 12 months from the date of each call, then automatically deleted
- Recordings, transcripts, and summaries are accessible only to authorized users of your account
- Call audio is processed in real time by ElevenLabs and Gemini to conduct AI conversations, whether or not recording or transcription is enabled
- Turning a feature off stops new recordings or transcripts. It does not delete existing ones, which remain subject to the retention period above.
Enabling Recording or Transcription
Before enabling recording or transcription, you must acknowledge your responsibilities under this Section 11. A new acknowledgment is required each time a feature is enabled after being turned off. QuoteIQ keeps a record of each acknowledgment, including the user, the feature, and the date and time. You may turn either feature off at any time.
Your Legal Obligations
Recording and transcription laws vary by jurisdiction, and some states and countries require the consent of all parties to a call. If you enable recording or transcription, you agree that:
- You are solely responsible for determining whether recording, transcribing, monitoring, or processing telephone conversations is permitted under all applicable federal, state, local, and international laws.
- QuoteIQ plays a standard notice at the start of each call when recording or transcription is enabled. You are responsible for providing any additional notices, obtaining any consents required by law, and maintaining appropriate records of such consent.
- QuoteIQ does not determine whether your use of these features complies with applicable law. The availability of a feature does not constitute legal advice, authorization, or a representation of legal compliance.
- You are responsible for configuring and using these features lawfully, including complying with applicable privacy, consumer protection, telecommunications, and AI disclosure requirements.
- To the fullest extent permitted by applicable law, you shall defend, indemnify, and hold harmless QuoteIQ LLC and its members, managers, officers, employees, contractors, and agents from and against any third-party claims, damages, liabilities, penalties, and reasonable attorneys’ fees arising from your unlawful use of recording or transcription features or your failure to provide required notices or obtain required consent, except to the extent caused by QuoteIQ’s gross negligence or willful misconduct.
QuoteIQ reserves the right to disable or restrict recording or transcription when necessary to address legal, security, or compliance concerns.
ClientHub Calls
The settings, caller notice, acknowledgment, retention, and obligations in this Section 11 also apply to recording and transcription of calls placed or received through ClientHub. For ClientHub calls, the caller notice states that the call may be recorded and transcribed.
Virtual Call Team Pricing
- IQ Credits: 125 IQC = 1 minute of call time
- Per-minute billing: $1.25 per minute base fee, billed per minute after the first 60 seconds
- Auto-recharge: $25 auto-recharge is applied if your balance drops below 10 minutes
12 SMS, Calls & Communications
12.1 Scope and QuoteIQ’s Role
QuoteIQ enables you to send SMS/MMS messages, emails, and phone calls, including automated, prerecorded, and AI-voice calls, to your End Customers and other recipients (“Recipients”) through ClientHub, Email & Text Automation, Mass Text/Email Campaigns, AI Auto-Reply, Virtual Call Team, and related features (collectively, “Messaging Features”). QuoteIQ provides the messaging infrastructure through Twilio, SignalHouse (SMS/MMS and voice), and SendGrid (email). Standard messaging rates from a Recipient’s wireless carrier may apply.
12.2 You Are the Sender
You are the sender and initiator of every message and call made through your account, including those sent by your Employee Users and by automations, campaigns, AI features, or workflows configured by you or on your behalf. QuoteIQ acts solely as a technology provider. QuoteIQ does not select Recipients and does not review or approve your communications before they are sent. You are solely responsible for the content, timing, frequency, and lawfulness of all such communications.
12.3 Consent
You represent, warrant, and covenant that, before sending any message or placing any call through the Messaging Features, you have obtained every consent required by the Telephone Consumer Protection Act, 47 U.S.C. § 227 (“TCPA”), and its implementing regulations, the Telemarketing Sales Rule, the CAN-SPAM Act, state telemarketing and “mini-TCPA” laws, and wireless carrier and CTIA requirements (collectively, “Messaging Laws”). Without limiting the foregoing:
- You must obtain prior express written consent before sending any marketing or promotional message, and such consent may not be made a condition of purchase;
- Each consent must clearly identify your business as the sender and disclose that messages may be recurring and automated, that message frequency varies, that message and data rates may apply, and how to opt out;
- You will send messages only within the scope of the consent obtained; and
- You will not send marketing messages to any number on the National Do Not Call Registry or any state do-not-call list unless an exemption applies under Messaging Laws.
Any consent setting, checkbox, or default within the Services is a tool for your convenience. It does not establish that valid consent exists, and you remain responsible for verifying consent for every Recipient.
12.4 Prohibited Contact Lists
You shall not upload, import, or send messages or place calls to any purchased, rented, borrowed, shared, scraped, or third-party contact list, including leads obtained through door knocking, lead-generation services, or any other list or data source, or to any Recipient for whom you cannot produce documented consent. Contacts imported or created without consent captured through the Services may be designated “consent unverified,” and you shall not send marketing messages to them unless and until you attest, in the manner the Services require, that valid consent has been obtained.
12.5 Opt-Outs
You must honor every opt-out request, whether made by reply keyword (including STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, and OPT OUT), by any other reasonable means, or directly to you, within the time required by Messaging Laws. You shall not circumvent, override, or disable any opt-out handling provided by the Services, and you shall not contact an opted-out Recipient by any means unless that Recipient affirmatively opts in again.
12.6 Sending Hours and Frequency
You must send marketing messages and place marketing calls only during the hours, and within the frequency limits, permitted by Messaging Laws in the Recipient’s local time zone. Certain states impose stricter limits than federal law. QuoteIQ may enforce sending windows or frequency limits that are more restrictive than applicable law, and is not liable for messages delayed or not sent as a result.
12.7 Automated, Prerecorded, and AI-Voice Calls
Calls placed using AI-generated, synthetic, or prerecorded voices, including calls placed through Virtual Call Team batch calling, are calls using an artificial or prerecorded voice under the TCPA. Before placing any such call, you must obtain the Recipient’s prior express consent, and prior express written consent for any call that includes advertising or telemarketing. You are responsible for (i) scrubbing Recipients against applicable do-not-call lists; (ii) disclosing at the outset of each call that the caller is an automated or AI system where required by law; (iii) identifying your business by name; and (iv) providing any recording notice required by Section 11. You shall not configure any AI feature to represent that it is a human being.
12.8 Email
Email sent through the Messaging Features must comply with the CAN-SPAM Act and applicable state law, including accurate header and sender information, clear identification of advertising where applicable, a valid physical postal address for your business, and a functioning unsubscribe mechanism. You must honor unsubscribe requests within ten (10) business days and shall not remove, disable, or obscure any unsubscribe link the Services insert.
12.9 Messaging Outside the United States
If you send messages or place calls to Recipients outside the United States, or use a phone number provisioned in another country, you are solely responsible for complying with that jurisdiction’s anti-spam, telemarketing, and privacy laws, including Canada’s Anti-Spam Legislation (CASL), the UK Privacy and Electronic Communications Regulations, the EU ePrivacy Directive and GDPR, and Australia’s Spam Act. QuoteIQ may restrict international messaging at any time.
12.10 Carrier Registration (A2P 10DLC)
Text messaging requires Application-to-Person (A2P) 10-Digit Long Code (10DLC) brand and campaign registration through QuoteIQ’s messaging providers. You must provide accurate and complete business information for registration and any identity verification QuoteIQ or its providers require, keep that information current, and complete registration before sending. You authorize QuoteIQ to submit that information on your behalf. QuoteIQ may, in its sole discretion, permit or refuse sending under a shared QuoteIQ campaign or number pending your registration, and may withdraw that permission at any time. Registration fees and carrier surcharges may be passed through to you.
12.11 Prohibited Content
You shall not send messages or make calls that (i) are false, misleading, or deceptive; (ii) relate to sex, hate, alcohol, firearms, tobacco, cannabis or CBD, gambling, high-risk financial services, debt collection, or other content restricted by wireless carriers; (iii) contain phishing, malware, or deceptive links; (iv) use link shorteners or URLs that obscure the destination where carriers prohibit them; (v) harass or threaten any person; or (vi) otherwise violate Messaging Laws or carrier policies. Every message must identify your business by name.
12.12 Consent Records
You shall maintain records sufficient to prove consent for each Recipient, including the date, time, method, and language of consent, for no less than four (4) years after your last communication with that Recipient, and shall produce such records to QuoteIQ within five (5) business days of request. Consent records generated by the Services are provided for your convenience and do not relieve you of this obligation.
12.13 Monitoring, Suspension, and Termination
QuoteIQ may, but has no obligation to, monitor messaging and calling activity. QuoteIQ may immediately suspend or terminate your access to any Messaging Feature, with or without notice, if QuoteIQ in its sole discretion believes you have violated this Section 12 or Messaging Laws, or upon receipt of a Recipient complaint, carrier notice, elevated opt-out or complaint rates, or legal demand. QuoteIQ has no liability for any such suspension or termination, and no fees will be refunded on account of it.
12.14 QuoteIQ-Provisioned Phone Numbers
Certain features of the Services, including ClientHub, Email & Text Automation, Mass Campaigns, and the Virtual Call Team, may include access to a business-specific phone number provisioned through our messaging and telephony providers (Twilio/SignalHouse) for the purpose of sending and receiving SMS/MMS messages or handling calls in connection with your business (a “Provisioned Number”).
You acknowledge and agree that:
- Ownership. All Provisioned Numbers are owned and controlled by QuoteIQ or its providers and are made available to you only as a feature of your active Subscription Plan. You obtain no ownership interest in, or property right to, any Provisioned Number.
- Non-Transferable; No Port-Out Obligation. Provisioned Numbers are non-transferable by you. QuoteIQ is under no obligation to port, release, or transfer any Provisioned Number to you or to any alternative carrier, platform, or service, whether during your subscription or upon its cancellation or termination.
- Reclamation. Upon cancellation or termination of your subscription, or of the Subscription Plan tier that grants access to the applicable feature, or upon expiration of your account, QuoteIQ may reclaim, deactivate, and reallocate any Provisioned Number that is no longer linked to an active subscription in a tier granting access to that feature. QuoteIQ is not liable for any loss, disruption, or missed communications resulting from such reclamation or from the deactivation of any Provisioned Number.
- Compliance. Your use of any Provisioned Number is subject to this Section 12 and to your indemnification obligations under Section 24.
12.15 QuoteIQ-to-User Communications
By creating an account, you consent to receive transactional communications from QuoteIQ by email and in-app notification, including account, billing, security, and support messages. Where you separately agree at signup or in your account settings, QuoteIQ may also send you transactional text messages and calls regarding your account, and, only with your separate prior express written consent, marketing text messages and calls. Consent to marketing messages is not a condition of purchase. You may opt out of text messages at any time by replying STOP, and out of marketing email by using the unsubscribe link or contacting support@quoteiq.io.
12.16 Indemnification and Limitation of Liability
Without limiting Section 24, you shall defend, indemnify, and hold harmless QuoteIQ LLC and its members, managers, officers, employees, contractors, and agents from and against any and all claims, demands, lawsuits, class actions, arbitrations, regulatory investigations, carrier fines and penalties, judgments, settlements, losses, and expenses, including reasonable attorneys’ fees, arising out of or relating to (i) any message sent or call placed through your account; (ii) your breach of this Section 12; or (iii) your violation of Messaging Laws. QuoteIQ may select its own counsel at your expense, and you shall not settle any claim involving QuoteIQ without QuoteIQ’s prior written consent. Compliance tools provided by QuoteIQ do not relieve you of your obligations, and QuoteIQ makes no representation that your use of the Messaging Features complies with Messaging Laws. Message and call delivery is not guaranteed. Section 22 and Section 23 apply in full to all claims arising from the Messaging Features.
12.17 SMS Terms
The QuoteIQ SMS Terms, which govern text messages received by Recipients through the Services, are incorporated into these Terms by reference. Sections 12.12 and 12.16 survive any termination or expiration of these Terms or of your account.
13 GPS & Location Services
QuoteIQ uses geolocation data in several features:
EmployeeHub GPS Tracking
- When Employee Users clock in via Time Tracker Pro, QuoteIQ collects real-time GPS location data
- GPS tracking pauses during breaks and stops when the employee clocks out
- Only the current location is stored while clocked in; a historical location log is not maintained
- The last known location is retained on the employee profile until updated by a subsequent clock-in
Account Holder Obligations
If you enable GPS tracking for Employee Users, you are responsible for:
- Informing your employees that their location is tracked while clocked in
- Obtaining any consent required by applicable federal, state, or local law before enabling location tracking
- Complying with all applicable employment and privacy laws regarding employee monitoring in your jurisdiction
QuoteIQ provides the technology platform but does not provide legal advice regarding employee monitoring requirements.
Other Location Features
- MapMeasure Pro: Uses satellite imagery and geolocation for remote property measurement
- Route Optimization & Route Density: Uses job location data to optimize routes and visualize geographic job concentration
- GEO-Schedule / Map Calendar View: Displays scheduled jobs on a geographic map
You may disable location services through your device settings. Note that disabling location services will limit certain features.

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense.
25 Governing Law & Dispute Resolution
PLEASE READ THIS SECTION CAREFULLY. It requires most disputes between you and QuoteIQ to be resolved through binding individual arbitration, and it includes a class action waiver and a jury trial waiver. It affects your legal rights. You may opt out of arbitration within 30 days — see “Your Right to Opt Out” below.
Governing Law
These Terms and your use of the Services are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of the arbitration provisions of this Section. This Section applies to disputes arising under these Terms, any Supplemental Terms (including the QuoteIQ Payments Terms of Service and the QuoteIQ Affiliate Program Terms), and the Services.
Informal Dispute Resolution First
Before filing an arbitration demand or any claim, you and QuoteIQ agree to first attempt to resolve the dispute informally. You must send a written Notice of Dispute to support@quoteiq.io (subject line: “Notice of Dispute”) that includes your name, the email address associated with your account, a description of the dispute, and the relief you are seeking. QuoteIQ will send any Notice of Dispute to the email address associated with your account. The parties agree to negotiate in good faith for sixty (60) days from receipt of the Notice. The applicable statute of limitations is tolled during this period. An arbitration demand or claim filed without first completing this process shall be dismissed or stayed pending completion.
Agreement to Arbitrate
Except as set out under “Exceptions” below, you and QuoteIQ agree that any dispute, claim, or controversy arising out of or relating to these Terms, any Supplemental Terms, or the Services — including their formation, interpretation, breach, or termination — shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules then in effect (available at adr.org), as modified by this Section. QuoteIQ is a business-to-business service, and the Services are intended for business use only; disputes under these Terms are commercial in nature.
- The arbitration will be conducted by a single arbitrator.
- Any arbitration hearing may be conducted by videoconference or, at your election, in the county where you reside, in accordance with the AAA rules.
- Payment of filing, administration, and arbitrator fees will be governed by the AAA Commercial Arbitration Rules and applicable fee schedules.
- The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this arbitration agreement, except that the enforceability of the Class Action Waiver below shall be decided by a court of competent jurisdiction.
- The arbitrator may award the same individual relief that a court could award to an individual, and judgment on the award may be entered in any court of competent jurisdiction.
Class Action & Jury Trial Waiver
YOU AND QUOTEIQ EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION. All claims must be brought in the parties’ individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding. If this Class Action Waiver is found unenforceable as to a particular claim or request for relief, then that claim or request for relief (and only that one) shall be severed and may proceed in court, and all remaining claims shall proceed in arbitration; the parties agree that any court proceeding shall be stayed pending arbitration of the remaining claims.
Exceptions
Nothing in this Section prevents either party from: (a) bringing an individual claim in small claims court in a court of competent jurisdiction, if the claim qualifies; (b) seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights, or unauthorized access to or abuse of the Services; or (c) reporting a matter to, or seeking relief from, a federal, state, or local government agency.
Your Right to Opt Out
You may opt out of this arbitration agreement and Class Action Waiver. To opt out, email support@quoteiq.io with the subject line “Arbitration Opt-Out” within thirty (30) days of the date you first accept these Terms (or, if you were already a User when this Section took effect on August 17, 2026, within thirty (30) days of that effective date). Your opt-out notice must include your name and the email address associated with your account. Opting out of arbitration does not affect any other provision of these Terms. Opting out will not adversely affect your access to or use of the Services in any way.
Mass Filings
If twenty-five (25) or more arbitration demands of a substantially similar nature are filed against QuoteIQ by or with the assistance of the same law firm, group of law firms, or coordinated counsel, the parties agree that the AAA’s Mass Arbitration Supplementary Rules (or successor rules) shall apply, and the demands shall be resolved in staged batches. The parties agree to cooperate in a bellwether process in which a limited number of demands proceed first, followed by a mediation of the remaining demands informed by the bellwether results, before further batches proceed. The applicable statute of limitations is tolled for demands awaiting their batch.
Venue for Non-Arbitrated Disputes
Any dispute that is not subject to arbitration — including disputes brought by a party that has validly opted out, claims within the Exceptions above (other than small claims), and any action to compel arbitration or to confirm, vacate, or enforce an arbitration award — shall be commenced or prosecuted exclusively in the state and federal courts located in Chatham County, Georgia. You consent to the personal jurisdiction and venue of such courts and waive all defenses of lack of personal jurisdiction and forum non conveniens.
Statute of Limitations
Except where prohibited by applicable law, any claim or cause of action arising out of or related to the Services must be filed within one (1) year after the cause of action arose, or such claim is permanently barred.
Exclusions
The United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transaction Act (UCITA) are excluded from these Terms.
Severability & Survival
Except as stated in the Class Action Waiver above, if any portion of this Section is found to be unenforceable, the remainder shall remain in full force and effect. This Section survives the termination of your account or these Terms.
26 Electronic Communications & Signatures
By using the Services, you consent to receive electronic communications from QuoteIQ. You agree that all agreements, notices, disclosures, and other communications we provide electronically — via email, in-app notifications, or through the Services — satisfy any legal requirement that such communications be in writing.
You agree to the use of electronic signatures, contracts, orders, and other records, and to the electronic delivery of notices, policies, and records of transactions initiated or completed through the Services. You waive any rights under any laws that require an original signature, delivery of non-electronic records, or non-electronic payment methods.
